Time To Rein In The BATFE

The federal Bureau of Alcohol, Tobacco, Firearms and Explosives has been on a tear under the administration of Attorney General Alberto Gonzalez.

Manufacturers of various products have been told in writing that their products are not a firearm and that they can be marketed outside the federal paperwork system for selling firearms. Then, months or years later, BATFE sends another letter reversing the first determination.

The Congressional Research Service found in 2005 (ATF Firearms Procedures) that BATFE has no written procedures for determining what is a firearm. The "process" is arbitrary, and the string of reversals in recent months shows how capricious a BATFE determination is.

Historic Arms received a letter of determination in 1995 that its BM-3000 was not a firearm. Indeed, Historic Arms had designed the product as an accessory for a machine gun to fire different kinds of ammunition than the gun had originally been designed to fire. For 11 years, the company manufactured their product without incident. But in 1996, Historic Arms received a second letter determining that the product was actually a machine gun!

As in other cases, BATFE wanted all the company's products sent to Washington along with all the names of the customers who had purchased the item.

In 2004, the BATFE determined that the Akins Accelerator was a "non firearm" accessory that allowed a shooter to bump fire a semi-auto and considerably increase the rate of fire. This year, BATFE has determined that the trigger finger which is bumping the trigger is itself a machine gun! Again, send in all the product and customer names.

For years, Centerfire Systems had a parts kit that it sold for machine guns. Now, six years later, BATFE has reversed itself on this company. And, the Bureau has put Centerfire Systems through the same drill -- send in their products and their customer lists.

In a related matter involving the definition of what makes a gun a "gun," KT Ordnance was raided by BATFE last year and its products were confiscated. What were the dangerous items? A parts kit for customers to legally make their own (unregistered) firearm. Again, BATFE wanted the customer list.

The capricious activities by the BATFE wreck economic chaos on these companies, in addition to violating both theirs and their customers' rights protected by the Second Amendment.

It is time for the BATFE to put their procedures for determining what is a firearm, and what is a machine gun, in writing.

This latest bait and switch is but another backdoor effort on the part of the federal government to attack gun ownership. This time the attack is on manufacturers.

ACTION: Please contact Pres. Bush. If we do not restrain BATFE now, they will do immeasurable damage to the firearms industry in the United States.

I am outraged that BATFE still has no written procedures for determining what is a firearm, and what is a machine gun. It has now been two years since the publication of ATF Firearms Procedures by the Congressional Research Service when they revealed that Firearms Technology Branch has no written procedures.

The Bureau has been in existence for over 30 years. How many prosecutions have put gun owners and manufacturers in jail based on shifting, arbitrary and capricious "exper"” testimony in court which is not based on written procedures?

When is the BATFE going to publish proposed written procedures for the public to comment on them? When is the Justice Department going to review the conviction of every gun owner and manufacturer where a BATFE "expert" testified against him?

Please have the BATFE take action on these problems right away.

The Town the Law Forgot

The first sign of trouble for Cudahy City Council candidate Tony Mendoza was a pair of thong panties mailed to his wife, with a note telling her to watch her husband’s back. Then came the phone calls — and the death threats.

A political novice in a tiny city of Mexican immigrants that hasn’t had an election since 1999, Mendoza had expected dirty tricks. But to his dismay, the caller, who spoke poor English and called every day for three days, said Mendoza would be killed if he did not leave Cudahy, a 1.2-square-mile city 10 miles southeast of downtown Los Angeles. After the third call, Mendoza pulled out of the March 6 race. “I have my family to think about,” he said.

Running for council seats against a slate of incumbents in a city infested with gangs and drugs, Danny Cota and Luis Garcia faced similar tactics. A truck owned by Garcia, a former city employee, was painted with graffiti, and ex-felon and Cudahy city employee Gerardo Vallejo sought a restraining order against Garcia for criminal threats. A judge tossed the complaint, but Garcia’s campaign was rattled....
Cudahy is a strange little city; some say a scary one. In 2003, city leaders fired the L.A. County Sheriff’s Department — which had policed Cudahy for 14 years, focusing on gang and drug crime — in favor of a nearby municipal police force that recently erupted over public allegations of police brutality and kickbacks to police and city officials from a towing company.

In Cudahy, the U.S. Drug Enforcement Agency has seized almost 20 times more cocaine over the past five years than in Bell, a bordering city of similar size, and the city suffers more crime per capita than small towns nearby. It’s a city with 200 active gang members, where shootings are common though homicide rare — that is, until 11 killings occurred in the wake of the sheriff’s departure in 2003...

Climate Panel Recommends Global Temperature Ceiling, Carbon Tax

A panel of scientists has presented the United Nations a detailed plan for combating climate change. VOA's correspondent at the U.N. Peter Heinlein reports the strategy involves reaching a global agreement on a temperature ceiling....

Holdren, however, says even these measure will achieve very little unless they are accompanied by a global tax on greenhouse gas emissions. "We don't think ultimately society will get it right in terms of the full range and scope of activities needed to reduce greenhouse gas emissions, until there is an additional incentive in the form of a price on greenhouse gas emissions, either through a carbon tax or a cap and trade approach," he said.

Help make English our official language

A common language, not “diversity,” makes our country stronger

Recently, the mayor of Nashville vetoed a bill that would have made English the city’s official language. He called the measure “unconstitutional, unnecessary, and mean-spirited.” U.S. Senate Majority Leader Harry Reid even called a bill to make English our official language “racist.”

A Zogby poll last year showed that 84% say English should be the official language of government operations. The poll also showed that 77% of Hispanics support English as our official language.

It is time for liberal members of Congress to quit playing politics with the future of all children --U.S. and Immigrant--and follow the lead of 28 states which have made English their official language. Failure for Congress to act will establish a major obstacle for immigrant children as they try to move up in our society.

Without a common language, citizens cannot communicate with each other. Any child growing up in America without knowing English is at a distinct disadvantage. At a time when our society is becoming more fragmented, we need an official, common language. Diverse cultures, different backgrounds and varied traditions enrich our culture. But for the nation to thrive, we must have a common language.

In August of 2006, we warned our readership about the coming North American Union, a plan to merge Canada, Mexico and the US into a single economic and political entity a la the European Union. You can read our alert, "Another Back Door for Gun Control" here: http://www.jpfo.org/alert20060815.htm

At that time, the planned NAU was (supposedly) still a theory, one new harebrained scheme among so many others proposed by the government elite safely ensconced in their ivory towers. Disturbingly, that no longer appears to be the case.

According to a recent article in the New American ( http://www.thenewamerican.com/artman/publish/article_4468.shtml or http://tinyurl.com/2vlzt3 ), in 1998, four "North American" business schools teamed up to create the PanAmerican Partnership, a business-training program sponsoring training and research emphasizing North American economic integration, and dedicated to building "the next generation of North American managers."

1998. That's seven YEARS before the Security & Prosperity Partnership -- a precursor to the NAU proposal -- or the Council on Foreign Relations's report "Building a North American Community" appeared.

Why be concerned? Because neither Mexico nor Canada recognizes inherent, natural rights. All of their "rights" are actually privileges, granted by the government, and subject to removal at the government's whim. A North American Union would effectively eliminate the Bill of Rights. Since neither Mexico nor Canada recognizes the right to keep and bear arms, it's a virtual certainty that the Second Amendment would be the first right to be eliminated.

It's official: Mexican trucks coming

One hundred Mexican trucking companies will have unlimited access to U.S. roads to haul international cargo as part of a year-long pilot program, the Department of Transportation announced today

In return, 100 U.S. trucking companies will be allowed to operate in Mexico but at a later date.

Calling for congressional hearings, Teamsters General President Jimmy Hoffa compared the announcement to the "Dubai Ports debacle," charging President Bush is "playing a game of Russian roulette on America's highways."

More than 23,000 American soldiers have been injured in Iraq and Afghanistan. Nearly 1,000 have lost a limb, and amazingly, a Team 4 Investigation found many of those injured veterans are now fighting the U.S. government for disability benefits.

Team 4's Paul Van Osdol has more on the story.

It all comes down to this: The Veterans Administration is clogged with hundreds of thousands of claims, and that logjam is forcing some of our wounded soldiers to wait more than a full year to get the benefits due them.

Roadside bombs, snipers, mortars, death and injury stalk American soldiers in Iraq and Afghanistan.

Sgt. Doug Gindlesperger of the U.S. Army National Guard led security patrols in Iraq knowing at any moment that he could be in immediate danger.

In 2005 he was flown out of Iraq, suffering from post-traumatic stress.

Years later, driving down country roads near his Somerset County home, Gindlesperger said he still has flashbacks.

"They used a lot of animals for explosive devices over there and being in Somerset County, being a deer hunter, seeing a road kill, it gives you that flash, know what I mean?" said Gindlesperger.

But 18 months after coming home, Gindlesperger is still fighting the Veterans Administration over his disability claim....

Illegal immigrant students brought to this country as children deserve a path to citizenship and affordable higher education, U.S. House Speaker Nancy Pelosi said during a visit to Arizona State University on Monday.

Pelosi, a California Democrat, joined three of Arizona’s Democrat congressmen — Reps. Ed Pastor, Harry Mitchell and Raul Grijalva — to rally support for efforts to increase federal financial aid.

The topic, however, turned toward the border. Pelosi pledged to move legislation that would improve citizenship and education opportunities for illegal immigrant students.

“This March, you will have an immigration reform act that will include the Dream Act,” Pastor said.

The legislation would allow illegal immigrants who graduate from high school in the U.S., have lived here for five years and arrived prior to turning 15, to attend college for in-state tuition.

Once enrolled, those students would be given six years of legal residence during which they must complete two years worth of college credit or military service to earn citizenship....

...Fully 12% of Muslim Canadians polled by Environics said the alleged terrorist plot -- that included kidnapping and beheading the prime minister and blowing up Parliament and the CBC -- was justified.

Female Pakistani minister shot dead for 'breaking Islamic dress code'

A Pakistani minister and woman’s activist has been shot dead by an Islamic extremist for refusing to wear the veil.

Zilla Huma Usman, the minister for social welfare in Punjab province and an ally of President Pervez Musharraf, was killed as she was about to deliver a speech to dozens of party activists, by a “fanatic”, who believed that she was dressed inappropriately and that women should not be involved in politics, officials said.

Mrs Usman, 35, was wearing the shalwar kameez worn by many professional women in Pakistan, but did not cover her head.

The attack happened in Gujranwala, 120 miles southeast of Islamabad, where the minister’s office is based. As Ms Usman, 35, stepped out of her car – where she was greeted by her co-workers throwing rose petals - the attacker pulled out a pistol and fired a single shot at close range, hitting her in the head. She was airlifted to hospital in the provincial capital Lahore, but died soon afterwards.

The gunman, Mohammad Sarwar, was overpowered by the minister’s driver and arrested by police. A stone mason in his mid 40s, he is not thought to belong to any radical group but is known for his fanaticism

Comment: "not thought to belong to any redical group"... . Give me a break. ... "he told a television channel that he had carried out God’s order to kill women who sinned. “I have no regrets. I just obeyed Allah’s commandment,” he said, adding that Islam did not allow women to hold positions of leadership. “I will kill all those women who do not follow the right path, if I am freed again,” he said.

Making Martial Law Easier

A disturbing recent phenomenon in Washington is that laws that strike to the heart of American democracy have been passed in the dead of night. So it was with a provision quietly tucked into the enormous defense budget bill at the Bush administration’s behest that makes it easier for a president to override local control of law enforcement and declare martial law.

The provision, signed into law in October, weakens two obscure but important bulwarks of liberty. One is the doctrine that bars military forces, including a federalized National Guard, from engaging in law enforcement. Called posse comitatus, it was enshrined in law after the Civil War to preserve the line between civil government and the military. The other is the Insurrection Act of 1807, which provides the major exemptions to posse comitatus. It essentially limits a president’s use of the military in law enforcement to putting down lawlessness, insurrection and rebellion, where a state is violating federal law or depriving people of constitutional rights.

The newly enacted provisions upset this careful balance. They shift the focus from making sure that federal laws are enforced to restoring public order. Beyond cases of actual insurrection, the president may now use military troops as a domestic police force in response to a natural disaster, a disease outbreak, terrorist attack or to any “other condition.”

Changes of this magnitude should be made only after a thorough public airing. But these new presidential powers were slipped into the law without hearings or public debate. The president made no mention of the changes when he signed the measure, and neither the White House nor Congress consulted in advance with the nation’s governors.

There is a bipartisan bill, introduced by Senators Patrick Leahy, Democrat of Vermont, and Christopher Bond, Republican of Missouri, and backed unanimously by the nation’s governors, that would repeal the stealthy revisions. Congress should pass it. If changes of this kind are proposed in the future, they must get a full and open debate.

Ramos attorney calls for mistrial

The prosecutor in the high-profile case that sent border agents Ignacio Ramos and Jose Compean to prison never showed the defense a potentially exculpatory Department of Homeland Security memo.

The document, an April 12, 2005, memo by Special Agent Christopher Sanchez, was first made public by WND in a report published Feb. 6. Mary Stillinger, attorney for Compean, confirmed she learned of the memo from the WND story.

"This is huge," Stillinger told WND, arguing the government's failure to disclose the document to the defense denied her client his right to a fair trial and establishes the basis for declaring a mistrial.

We all remember the embarrassing list of presidential pardons that finalized Bill Clinton’s legacy of sleaze. It was a tawdry list of 145 drug dealers, income tax evaders and the notorious Marc Rich, who fled the United States in the midst of his trial on charges of making oil deals with Iran during the hostage crisis.

Clinton also pardoned corrupt former Congressman Dan Rostenkowski (18 terms, 17 indictments) and his own cokehead brother, Roger Clinton.

Since taking office, George W. Bush has issued 113 pardons, but there are four more he needs to add to his list.

Ignacio Ramos and Jose Compean, two former border patrol agents, are now serving hard time in prison. If you are unfamiliar with these two men, you are getting far too much of your news from the mainstream media, which has virtually ignored their story. Ramos and Compean were on duty along the Rio Grande in Texas when a Mexican drug smuggler named Osbaldo Aldrete-Davila tried to flee back across the river into Mexico. Aldrete-Davila brandished what the agents thought was a gun. Ramos and Compean fired their firearms at the suspect, but when he continued to flee, they logically assumed he had not been injured.

Fast forward two weeks, and our tax dollars were being used to transport the drug smuggler back into the United States, where he was given full immunity to testify against Ramos and Compean — for shooting him in the buttocks! They were tried and sentenced to ten years each.

Subsequent information has shown that “evidence” brought against Ramos and Compean was fabricated by officials from the U.S. Department of Homeland Security. Certain members of Congress are investigating. Meanwhile, these two valiant agents rot in prison. In fact, Ramos recently was attacked by Latino gang members in his cell in Yazoo City Federal Correctional Complex in Mississippi and beaten bloody.

The fate of Ramos and Compean may be a cakewalk compared to what awaits Duane “Dog” Chapman, known to watchers of his A&E cable program as “Dog the Bounty Hunter.” In 2003, Dog and his posse caught and captured the notorious serial rapist Andrew Luster, who is now spending several decades in prison. Unfortunately, Dog and the guys caught up with Luster in the Mexican city of Puerto Vallarta. Now, believe it or not, the Mexican government is demanding that Duane Chapman be extradited back to Mexico to stand trial for “deprivation of liberty.” And one of our pin-headed federal judges has approved the extradition!

Finally, there is the case of Lewis “Scooter” Libby, whose primary crime was serving as chief of staff for one of the Left’s most hated enemies, Vice President Dick Cheney. As former U.S. Sen. Fred Thompson, R-TN, has said, this trial is “a travesty and an injustice.” As chairman of the Senate Government Affairs Committee in the late 1990s, Thompson led the effort to allow the Office of Independent Counsel to expire.

Additionally, Thompson pointed out, it was obvious that Valerie Plame, the CIA operative whose identity was leaked, was not covered under the Intelligence Identities Protection Act.

“When you put too much power in the hands of unelected, unaccountable people who have every incentive to focus massive resources onto one particular person, and gets the plaudits in the media for doing so, it’s a bad thing,” Thompson said in an interview with ABC News after attending part of Libby’s trial. “Many, many times an injustice can occur.”

So let’s review: Two border agents shoot a drug smuggler and end up serving time in federal prison. A bounty hunter brings a dangerous serial rapist to justice and gets extradited to face the hell of a Mexican prison. And Scooter Libby faces a possible sentence of 20 years in prison for leaking the name of a CIA employee whose name was already known, while Bill Clinton’s former security advisor, Sandy Berger, gets a slap on the wrist for stuffing Top Secret documents in his pants and stealing them from the National Archives.

Pardon these men immediately, Mr. President.

Cabbie Runs Down Students

NASHVILLE, Tenn. -- A local cab driver allegedly tried to run over two customers after a fight over religion became heated.

The incident happened early Sunday morning on the Vanderbilt campus and left one man hospitalized and a cab driver arrested, said police

Two students visiting from Ohio were coming from a bar downtown when they got into an argument with their driver over religion, said police. After they paid the driver he allegedly ran them down in a parking lot.

Ibrihim Ahmned, of United Cab, was arrested and charged with assault, attempted homicide and theft. One of the passengers, Andrew Nelson, managed to outrun the cab but Jeremy Invus was taken to the Vanderbilt University Medical Center with serious injuries, said police.

Ahmed has been convicted of misdemeanors including evading arrest in a motor vehicle and driving on a suspended license, said police.

Ahmed was charged with theft because police said the license plate on his cab was listed as stolen. His bond is set at $300,000.

Classifying Your Firearms into Oblivion
In 2003, Akins Group Inc. developed the Akins Accelerator, a bumpfire stock for a Ruger 10/22 that can produce about 650 rounds/minute. The company received classification letters from the BATFE agreeing that the stock was not a firearm and therefore unregulated.

Akins performed approximately 18 months of testing, built injection molds based on the results, and began offering the Accelerator to the public in December of 2006.

True to form, the BATFE suddenly decided that the plastic stock was in fact a machine gun. The considerable time, effort, and of course money Akins invested into the project has been rendered essentially useless. You can read the entire saga at http://www.firefaster.com/documentation.html .

As our regular readers are aware, this isn't the first time that the BATFE has changed its mind on a classification. Our "Boot the BATFE" page at http://www.jpfo.org/bootbatfe.htm has several ATF Reconsideration letters listed.

It's important to realize what this really means. The ATF tells a manufacturer that a particular product is legal and acceptable. Based on this, the manufacturer invests large sums of money to produce the product, and even begins distributing the product. AFTER the money is spent, AFTER the inventory has been built, AFTER customers have purchased the product, the BATFE says, "Oops, just kidding. It's illegal."

Now the manufacturer has wasted valuable capital and his customers are in possession of products that could get them fined or jailed! All because the BATFE changed its mind.

It gets worse.

The BATFE is declaring by fiat that this product or that is "illegal". There's no legislation involved. No Congressional hearings. No oversight at all. Just a bureaucrat stating, "Yeah, this is illegal." Your only recourse is to beg them to reconsider again (and how likely is that?)

If the BATFE is reclassifying plastic rifle stocks to be "machine guns", what's to stop them from reclassifying semi-autos as "machine guns"? After all, your semi-auto has "characteristics and features of a machine gun" (the BATFE's favorite phrase lately). And if a shoelace can be classified a machine gun (yes, really! http://www.jpfo.org/shoestring.jpg), then why not?

Here is yet more proof -- as if we didn't have enough -- that the BATFE is an unelected rogue agency run amok. It is a law unto itself; as many people have found, merely criticizing it can result in dire consequences.

Firearms Industry Takes Aim at Micro-Stamping Bill

NEWTOWN, Conn., Feb. 16 /PRNewswire-USNewswire/ -- The National Sports
Shooting Foundation (NSSF), the firearm industry's trade association,
commenting on Assembly Member Mike Feuer's (D-West Hollywood) introduction
yesterday of legislation to mandate "firearms micro-stamping," said similar
legislation failed last year and vowed to oppose any legislation to mandate
such a flawed and unreliable technology that can so easily be defeated.
Assembly Member Feuer's predecessor, Paul Koretz, introduced AB 352
last session, but the bill failed passage. These bills would require
manufacturers to micro-laser engrave on the tip of the firing pin the gun's
make, model and serial number so, in theory, that information would be
imprinted on any cartridge casing fired in the gun.
"Firearms micro-stamping failed last year because members of the
legislature were aware that an independent peer-reviewed study had proven
that this patented, sole-sourced technology is unreliable and does not work
as advertised by the patent holder who stands to get very rich if this
technology is mandated," said Lawrence Keane, NSSF senior vice president
and general counsel. "This study also proved that the shallow engravings --
to a depth of less than a diameter of a human hair -- are easily
obliterated in seconds using common household tools. Even the patent holder
admitted the engravings could be easily removed. Criminals could also
replace engraved firing pins with spare pins that are widely available."
Researchers at U.C. Davis are currently studying the reliability of
this technology. Their results are expected to be released this month at a
meeting of the American Academy of Forensic Sciences. "Clearly, further
study, like the one currently underway at U.C. Davis, should be completed
before the legislature even considers mandating this unreliable, easily
defeated and costly measure," added Keane.
Major law enforcement groups, including the Peace Officers Research
Association of California and the Orange County Sheriff, are on record as
opposing firearms micro-stamping.
"This legislation will not only force consumers of firearms to pay
exorbitant fees to cover micro-stamping costs, but it will also lead to
substantially higher taxes for all California residents as they are forced
to foot the bill for micro-stamped law enforcement guns," concluded Keane.
NSSF called upon members of the hunting, shooting and firearms
community to contact their legislators in the California Assembly and urge
them to vote "no" on any micro-stamping measures.

SAF Victory in New Orleans, Judge Grants Contempt Motion

BELLEVUE, Wash., Feb. 13 /PRNewswire-USNewswire/ -- A United States
District Judge in New Orleans has granted a motion to hold Mayor C. Ray
Nagin and Police Superintendent Warren Riley in contempt for failure to
provide initial disclosures and answers to discovery in a lawsuit filed by
the Second Amendment Foundation.
Judge Carl J. Barbier issued a blistering rebuke to New Orleans'
defense counsel for conduct that is "wholly unprofessional" and warned that
it "shall not be condoned." Judge Barbier ordered defense counsel to
reimburse SAF's attorney $1,365. SAF is joined in the lawsuit by the
National Rifle Association.
In his ruling, Judge Barbier noted, "Defense counsel has caused time
and money to be wasted by Plaintiffs' counsel and further admits that he
has 'no good reason' to explain his behavior."
"Throughout the past 17 months," said SAF founder Alan M. Gottlieb,
"our attorneys have acted professionally and they have been stonewalled or
ignored by the city and especially its defense attorney. This seems to be
the only thing that gets their attention, and it appears that Judge
Barbier's patience has grown as thin as our own."
"We gave New Orleans every opportunity to act like adults and deal with
this lawsuit in a professional manner," Gottlieb said, "and they've acted
as if this case didn't exist. Judge Barbier's ruling is a wake-up call.
"They seem to forget that we went to court over a serious civil rights
violation," Gottlieb continued. "In the days following Hurricane Katrina,
New Orleans dispatched police officers and National Guard troopers to
confiscate firearms. In many cases, citizens were disarmed at gunpoint,
without warrant and without probable cause. Nagin and Riley, and every
other official in New Orleans who was part of this outrage, need to
understand that the Constitution may not be suspended in New Orleans or
anywhere else by a natural disaster, or on somebody's whim.
"This is the first step toward forcing New Orleans to return seized
firearms to their rightful owners, and in our effort to find out who issued
that illegal order, and hold them responsible," Gottlieb stated. "We will
not rest until this case is resolved."

Support Swells for Agents Who Shot Drug Smuggler

Early this week, the Bush administration urged angry conservatives to remain calm over the convictions of two former Border Patrol agents who shot an unarmed Mexican drug smuggler, but petitions for their release continued to flood the White House.

It did not help that one the lawmen, Ignacio Ramos, was attacked by Latino gang members in his cell at the Yazoo City Federal Correctional Complex in Mississippi and beaten bloody. Days after prison officials confirmed the beating on Feb. 8, Department of Homeland Security officials admitted that an inspector general's report erroneously quoted Border Patrol agents as saying Ramos and his partner, Jose Compean, intended to kill Mexicans.

Comment: Reports are that the agents did report the shooting to supervisors. The reality is that our administration is in a perverted love making session with the mexican government. At least 28 bombs explode in Thailand

BANGKOK, Thailand - At least 28 bombs exploded Sunday in apparently coordinated attacks in parts of southern Thailand plagued by a Muslim insurgency, killing three people and wounding more than 50, the military said.

The bombings targeted hotels, karaoke bars, power grids and commercial sites in the country's southernmost provinces, the only parts of predominantly Buddhist Thailand with Muslim majorities. Two public schools were torched.

Police said three Thais of Chinese descent were also gunned down in Pattani province in what was believed to be the act of insurgents. The killings occurred as the country's Chinese community was celebrating the Lunar New Year Sunday.

Hunting the 2nd Amendment

Smuggler's 2nd delivery of marijuana confirmed

Utah gunman, 18, was Muslim from Bosnia

The 18-year-old gunman who killed five people in a crowded Utah shopping mall was a Bosnian Muslim refugee who was prepared to kill many more, say investigators.

An off-duty police officer having an early Valentine's Day dinner with his wife was credited today with cornering Sulejmen Talovic, exchanging fire with him until other officers arrived to shoot and kill the gunman.

The trench-coated teenager wanted to "to kill a large number of people" and probably would have killed many more if not for the off-duty officer, Police Chief Chris Burbank said.

Mexico demanded U.S. prosecute sheriff, agents

The Mexican Consulate played a previously undisclosed role in the events leading to U.S. Attorney Johnny Sutton's high-profile prosecution of Border Patrol Agents Ignacio Ramos and Jose Compean, who are serving 11 and 12 year sentences for their role in the shooting of a drug smuggler, according to documents obtained by WND.

And Mexican consular officials also demanded the prosecution of Texas Sheriff's Deputy Guillermo "Gilmer" Hernandez, who subsequently was brought to trial by Sutton, the documents reveal.

Rep. John Culberson, R-Texas – among a number of congressman who have fiercely opposed the prosecution of Ramos and Compean – told WND he has "long suspected that Mexican government officials ordered the prosecution of our law enforcement agents."

"Mexico wants to intimidate our law enforcement into leaving our border unprotected, and we now have confirmation of it in writing," Culberson said.

Police identify gunman as 18-year-old Bosnian

Police Tuesday identified the gunman accused in Monday night's Trolley Square shooting as Sulejman Talovic, an 18-year-old Bosnian refugee who lived in Salt Lake City.
Salt Lake City Police Chief Chris Burbank said Talovic drove his car to the mall, parked in the west parking terrace and encountered two people who he shot before entering the mall.
There, he encountered a female who also was shot right away, then went into a gift shop where there were five people, all of whom the young man shot. Moving through the mall, the gunman tried to shoot others, Burbank said. The chief said he could not say now how many shots were involved in the entire episode.
Burbank praised an unnamed Ogden police officer who took action at the mall to intervene in the incident, and praised the many law enforcement and other agencies that responded quickly and professionally to the crisis.
Until Salt Lake police arrived, it was "basically a shoot-out between the Ogden individual and this individual," Burbank said.

Comment: Accordingly to Michael Savage - this attacker was Muslim. There seems to be a total blackout about this. There have been several recent attacks by Muslims, and in each instance the fact is not disclosed.

Saugus rifle event shot down by legal fears

Project Appleseed is about planting the seeds of marksmanship and the spirit of the rifleman across the country.

President Theodore Roosevelt, a major proponent of marksmanship training, would be proud.

The nonprofit project was started by the Revolutionary War Veterans Association, a gun club in North Carolina.

The nationwide project began a year ago with the prospects of "preserving and passing on the heritage of rifle marksmanship that is the birthright of all Americans."

"Appleseed is about American as apple pie," said Fred Dailey, one of the founders. "All we want to do is teach marksmanship, teach about the Revolutionary War and leave behind better shooters."

The first event in California was scheduled this weekend at A Place to Shoot, a firing range in Saugus. Until it was abruptly canceled.

A message in the forum at www.rwva.org said "you're going to have a lot of company when you get here," said Art Rosbury-Yoder of RWVA.

The implication was that if the event went on, expect to have a problem, Rosbury-Yoder explained.

The ominous message prompted RWVA to pursue legal counsel. An attorney who is a firearms owner advised it "that certain California laws in conjunction with a potential strong anti-gun bias of some local prosecutors could create problems for the program and those who attend it."

The primary concern was the state militia law and the teaching of military-style marksmanship, which is found in the Olympics and is promoted nationwide (California included) in the Civilian Marksmanship Program.

BofA aims new credit card at illegal immigrants: report

NEW YORK (Reuters) - Bank of America Corp. has begun offering credit cards to customers without Social Security numbers, typically illegal immigrants, the Wall Street Journal reported on Tuesday.

In recent years, banks across the country have been offering checking accounts and even mortgages to the nation's fast-growing ranks of undocumented immigrants, most of whom are Hispanic, the paper said, adding these immigrants generally have not been able to get major credit cards.

The new Bank of America card is open to people who lack both a Social Security number and a credit history, as long as they have held a checking account with the bank for three months without an overdraft, the Journal said.

The tiny airline spy that spots bombers in the blink of an eye

Tiny cameras the size of a fingernail linked to specialist computers are to be used to monitor the behaviour of airline passengers as part of the war on terrorism.

Cameras fitted to seat-backs will record every twitch, blink, facial expression or suspicious movement before sending the data to onboard software which will check it against individual passenger profiles.

Scientists from Britain and Germany are spending £25million developing a system which they hope will make it virtually impossible to hijack an airliner by providing pilots and cabin crew with an early warning of a possible terrorist attack such as 9/11.

They say that rapid eye movements, blinking excessively, licking lips or ways of stroking hair or ears are classic symptoms of somebody trying to conceal something.

A separate microphone will hear and record even whispered remarks. Islamic suicide bombers are known to whisper texts from the Koran in the moments before they explode bombs.

The software being developed by the scientists will be so sophisticated that it will be able to take account of nervous flyers or people with a natural twitch, helping to ensure there are no false alarms.

Chertoff's 'Islam PC' rankles fed officials

Citing recent internal memos, Department of Homeland Security employees complain their boss Michael Chertoff is hamstringing counter-terror operations with pro-Islamic political correctness.

They say headquarters has cautioned officials not to describe Islamic terrorism as Islamic and to respect Islam as a "religion of peace."

"It's constantly drilled into us that Islam is not the enemy, and that the terrorists are merely a minority of 'extremists' distorting Islam," said one official who wished to go unnamed. ...

Author of DHS border-agent report lied to Congress

A heavily redacted Department of Homeland Security report on the prosecutions of Border Patrol agents Ignacio Ramos and Jose Compean was issued by Assistant Inspector General Elizabeth M. Redman, one of four investigators called upon to resign for lying to Congress.

The 77-page report – which Redman issued with her signature in November – was released to the public yesterday on the heels of DHS Inspector General Robert Skinner's admission at a hearing that his deputies falsely told lawmakers the agency had documentary proof the border agents were rogue cops "out to shoot Mexicans."

Yesterday, Culberson called for Redman and the three other officials to resign.

According to official documents in WND possession, a Department of Homeland Security agent played a major role in managing the drug smuggler and conducting the field investigation in the incident that landed Border Patrol officers Ignacio Ramos and Jose Compean in federal prison for more than a decade.

Yet, in the heavily redacted 77-page DHS report submitted to Congress Wednesday there is no explicit discussion of the role DHS Special Agent Christopher Sanchez played in the case.

Texas Lawmaker: Rescind Vaccine Order

AUSTIN, Texas (AP) -- A lawmaker and key ally of Gov. Rick Perry urged him Monday to rescind his executive order making Texas the first state to require girls to be vaccinated against the sexually transmitted virus that causes cervical cancer.
Lawmakers should have been allowed to hear from doctors, scientists and patients before the state implemented such a sweeping mandate, said state Sen. Jane Nelson, chairwoman of the health and human services committee.

Government admits lying about jailed border agents

A Department of Homeland Security official admitted today the agency misled Congress when it contended it possessed investigative reports proving Border Patrol agents Ignacio Ramos and Jose Compean confessed guilt and declared they "wanted to shoot some Mexicans" prior to the incident that led to their imprisonment.

The admission came during the testimony of DHS Inspector General Richard L. Skinner before the Homeland Security Subcommittee of the House Appropriations Committee, according to Michael Green, press secretary for Rep. John Culberson, R-Texas.

Culberson was questioning Skinner about a meeting DHS officials had Sept. 26 with him and three other Republican congressman from Texas, Reps. Ted Poe, Michael McCaul and Kenny Marchant...

Imam leads Democrats in prayer of conversion

With heads bowed reverently, Democrats were led in prayer yesterday by a Muslim imam who essentially asked Allah to assist in converting the party members to Islam, according to a scholar and author.

Right On: The straightforward arithmetic of jihad

It's time we open our eyes and confront reality. Ever since the September 11, 2001 terrorist attacks on the World Trade Center and the Pentagon, the media has sought to reassure us that only a tiny minority of Muslims actually support the use of violence against Israel and the West.

It's just a small fringe, a marginal few at best, they tell us, so don't worry about it all too much. One percent or three percent - who cares? Just sit back, enjoy your morning eggs and coffee and have a nice day.

But a look at the numbers tells a very different story. The extent of support for global jihad is frightening in its proportions, and the numbers are anything but insignificant.

Consider, for example, the following statistics regarding support for suicide bombings and other types of terror attacks.

In a poll conducted five months ago, and broadcast on Britain's Channel 4 TV, nearly 25% of British Muslims said the July 7, 2005, terror bombings in London, which killed 52 innocent commuters, were justified. Another 30% said they would prefer to live under strict Islamic Sharia law rather than England's democratic system.
